Why do you care about Whistleblowing in AI?

Dana Gold, Director of Advocacy and Strategy, in 2024:

“Tech workers who work in privately held companies like OpenAI are, unfortunately, very vulnerable legally. There is no one law that protects corporate or private employees for reporting the range of serious abuses.”

Gold noted that while Congress passed the Cyber Incident Reporting for Critical Infrastructure Act in 2022, which requires reporting of certain cyber incidents and threats, “there is no whistleblower protection section which would support employee enforcement of the act,” she said.

Gold said she would like to see more leadership in the tech sector and “more proactively embracing the role of employees as early-warning mechanisms to prevent problems that they acknowledge are enormous.”

Given the unlikelihood of a legislative fix, Gold said, “the tech industry can lead in implementing professional ethics standards like engineers, lawyers and doctors have to regulate the tech industry as a profession.”

Eric Ben-Artzi – uncovering multi-billion dollars security violations

In December 2012, Eric Ben-Artzi publicly exposed multi-billion dollar securities violations at Deutsche Bank after internally reporting inaccurate credit derivatives portfolio valuations. Following retaliation and dismissal, GAP filed a whistleblower complaint for him. Though awarded $8 million by the SEC, Ben-Artzi declined the payment.

Joel Clement – A Climate Scientist Speaks Up

a PhD biologist and former Senior Executive Service advisor on climate change at the Interior Department, was reassigned to an oil royalty office in 2017 as retaliation by Secretary Zinke. Unlike dozens of other reassigned SES employees, Clement blew the whistle, publishing a Washington Post op-ed and filing a complaint with the Office of Special Counsel. He’s now an advocate for scientific integrity in climate science and received the 2017 Joe A. Callaway Award for Civic Courage.

Ongoing: Government Accountability Project v. United States Office of Personnel Management for federal employee protection:

GAP and NARFE sued OPM and President Trump in February 2025. The lawsuit claims Executive Order 14171 illegally strips career federal employees of job protections, violates the Civil Service Reform Act, bypasses proper APA notice and comment procedures, and infringes on Fifth Amendment due process rights. The plaintiffs seek injunctive relief to block implementation of the order, which would allow political dismissals of previously protected civil service positions

Louis Clark has been Executive Director and CEO of Government Accountability Project since 1978, initially serving as legal counsel.

As former President, he represented the organization publicly, negotiated with officials on legal cases and reform initiatives, and met with international delegations to explain whistleblower protection methodologies. Clark oversees financial fraud cases for the Corporate and Financial Accountability Program, speaks on occupational free speech issues, and provides strategic advice to unite whistleblowers with citizens, interest groups, government leaders, congressional committees, and media to expose and solve problems.

Karen Gray is General Counsel for Government Accountability Project, joining in 2003 as a staff attorney before assuming her current role in 2007

Karen Gray is General Counsel for Government Accountability Project, joining in 2003 as a staff attorney before assuming her current role in 2007. She advises the Executive Director and staff, serves as legal liaison to the Board, and continues as a trial attorney. Gray also represents employees of NGOs with problematic internal justice systems through the International Program. A Howard University School of Law graduate with a psychology degree from Andrews University, her previous experience includes serving as Legal Director for a domestic violence center and working in private practice. She is admitted to the Maryland and DC Bars and the US District Court for DC, and belongs to multiple employment lawyer associations.

Tom Devine has served as Government Accountability Project's Legal Director since 1979, helping over 8,000 whistleblowers fight retaliation

Tom Devine has served as Government Accountability Project's Legal Director since 1979, helping over 8,000 whistleblowers fight retaliation and create meaningful change in areas like nuclear safety, food inspection, and dangerous pharmaceuticals. Undefeated since 2006, he has won cases at appellate courts and the Supreme Court.
Devine has championed 34 whistleblower protection laws globally, including the 1989 Whistleblower Protection Act, corporate whistleblower laws with jury trial rights, and international policies at the EU, UN, World Bank, and other organizations. His advocacy spans 36 countries, earning him the informal title "Ambassador of Whistleblowing" from State Department staff.
His book "The Corporate Whistleblowers Survival Guide" won the 2012 International Business Book of the Year Award. Devine has received numerous honors, including the Hugh Hefner First Amendment Award and induction into the FOIA Hall of Fame. A Georgetown University Phi Beta Kappa graduate and Antioch School of Law alumnus, he serves on the boards of the Disaster Accountability Project and Whistleblowing International Network.
